Gym and club memberships: annual fees, card surcharges, and cancellation charges

Who we are looking for

Minnesotans who joined, modified or renewed a health club, buying club or social referral club membership on or after January 1, 2025. That is the statute’s own gate: Laws 2024, chapter 114, article 3, sections 53 and 54 are “effective January 1, 2025, and appl[y] to contracts entered into, modified, or renewed on or after that date.” A renewal counts. We especially want to hear from people who cancelled and were charged anyway.

What we want to see

• The signed membership agreement, every page.
• A screenshot of the join flow, or the confirmation email, showing the monthly rate you were quoted.
• Bank or card statements showing the annual fee, the enrollment or administrative fee, or a card surcharge.
• The cancellation or termination notice you sent, and the club’s reply.
• Any charge after you cancelled — invoice, debit, or collection letter.

Why

Minn. Stat. § 325G.24, subd. 2(c): “A club must not impose a termination fee or any other liability on the member for termination under this subdivision.” Section 325G.23, subd. 8 sweeps enrollment, administrative and processing fees into one defined term, “no matter how the fee is denominated.” Section 325G.051, subd. 1(a)(4) caps a card surcharge at five percent. Section 325D.44, subd. 1a(a) bars advertising “a price … that does not include all mandatory fees or surcharges.”
